A person at least eighteen years of age who performs or submits to sexual intercourse or deviate sexual conduct commits sexual misconduct with a minor between 14 and 16 years of age, is guilty of a Class C felony. However, the offense is raised to a Class B felony if it is committed by a person at least twenty-one years of age.
